874. The meeting is presided by a notary or the clerk. If it is presided by a notary, the minutes of the meeting held to establish the council are homologated by the clerk.

874. Subject to the provisions of article 879, a notary may, under the same conditions as the judge and the prothonotary, convoke and preside over a family council, after having drawn up a deed showing the request which was made to him, together with the declaration of the applicant, both as to his capacity and as to the grounds for and the purpose of the convocation.
The notary takes the advice of the council, after having read to them the declaration of the applicant. His minutes must mention the oppositions made and the opinions given, as well as the capacity, the place of residence and the degree of relationship of the members of the council.
